What Questions Should You Ask a Divorce Attorney?

by Tanis McGonegal Family Law

You are ready to end your marriage, and you need a divorce attorney. But finding the right divorce lawyer can be a complicated task. Sure, a search may come up with dozens of attorneys in your area, but which one do you choose? How do you find the right one?

Divorce is a major legal event, so it is important that it is handled properly. You need a lawyer who has been there and done that, so to speak. If you have millions of dollars in property, you need someone with experience handling high-asset divorces.

Hiring a lawyer can be overwhelming. Here are the questions you need to ask at your first consultation.

How Many Divorces Have You Handled?

Divorce is complicated enough. You want someone you can trust, not someone who is fresh out of law school and has never handled a divorce. Therefore, you want to ask lawyers about their experience.

What are Your Fees?

Lawyers typically charge an hourly billing rate (typically several hundred dollars an hour) plus a retainer fee. Make sure you know the rates upfront to decide if you can afford the lawyer.

How Do You Approach Divorce?

Some lawyers have a collaborative approach to divorce and want to work things out outside of court. Others are combative and want to fight it out in court. Find out your lawyer’s personality and approach to divorce so you can decide if they are the right fit for you.

Do You Have Experience With Businesses or Complex Assets?

If you own a business or have complex assets, such as real estate or financial accounts, you want someone with experience dealing with the assets. They’ll need to negotiate settlements.

How Do You Prefer to Communicate?

Some lawyers prefer to talk to you over the phone, while others prefer emails or even texts. Ask the lawyer how they want to communicate with you and if you will be billed for doing so.

Will You Share Important Information With Me?

Some lawyers communicate on a weekly basis or only if a major development occurs. If you desire communication more often, then make sure to let your lawyer know if that is possible. Some attorneys are very busy and cannot call you whenever a minor event happens.
